BY-LAWS

          Whereas, in all well-regulated societies laws or rules are adopted as necessary for the order and government thereof, therefore we, the members of the Keansburg Fire Company #1 of Keansburg, N.J. in order to maintain a perfect union among ourselves, establish discipline, define duty, ensure tranquility and promote the objective for which we are associated, do agree to adopt and sustain the following for our By-Laws.

Article 1.   This Company shall be known and designated by the title of Keansburg Fire Company #1 of Keansburg, New Jersey.

 Article 2.   The fire district of this Company shall include all that territory within the Borough of Keansburg's limits.

(MEETINGS)

Article 3.   Section 1  The monthly meetings shall be held on the first Thursday of each month at 8:00 P.M. when business of the Company will be transacted, except when previously voted upon by a majority of members present.

                                    Section 2  Seven members, including the President, shall constitute a quorum for the transaction of business. 

                  Section 3  The annual meeting of this Company shall be held on the regular meeting in December of each year at 8:00 PM, when the officers shall be elected and committees appointed by the incoming President at the following January meeting.

 

(Active - Members)

Article 4.   Section 1  Any citizen between the age of 18 years old with a high school diploma, resident of this Borough, of good moral character, and having some known means of support, and a proven resident of the Borough for one year, desirous of becoming a member of this Company shall petition through some member at any regular meeting accompanied by an initiation fee of ten dollars ($10.00).  Application to be submitted on regular form required by the N.J. State Firemen's Relief Association.  The application must be subject to the approval of the Board of Fire Commissioners and the Borough Council.  Doctor's fee to be paid by the Board of Fire Commissioners.

                   Section 2  Active membership list shall not exceed the quota governed by the State at any one time. 

                  Section 3  Any person elected into membership shall serve a one year probationary period, during which time he shall attend drills, fires and other functions of the Company, at the end of the period a report shall be given to the Company committees on the ability of new member.  He may be subjected to dismissal from the Company during this period at the discretion of the membership.  Captain will be in charge of applications and process of new members. 

Section 4  Any active member, upon entering the Company, must pay one-half the cost of his uniform within one year, with the Company paying half.  Uniform to consist of coat, pants and hat.  Badge and key to the building will be presented by the Company with the member paying for replacement.  If member fails to serve his probationary period by reason of rejection of the Officers or the Company, or should he resign before his time his money shall be refunded on presentation of his house key. 

Section 5  No person shall be elected an active member of the Company if an active member of another Fire Company. 

Section 6  Active members, on resigning or being expelled from the Company, shall relinquish all claims to the Company property and equipment. 

Section 7    Any member with less than seven (7) years of service must do sixty percent (60%) of fire duty, attend one (1) regular meeting in each quarter of the calendar year, in addition each active member must attend five (5) bingos each quarter, (the quarters beginning in January and consisting of three months).  Any active member not making five (5) bingos within the same calendar year will result in a sixty (60) day suspension.  The second offense for not making five (5) bingos within the same calendar year will result in dismissal from the Company.  Failure to complete twenty (20) bingos for the year will result in dismissal from the Company.  A quarterly review by the Captain, Secretary, Financial Secretary, and Bingo chairman will be made as to each member's standing.  Not complying with the rules set forth in this article, a member will forfeit his right to vote in the Annual election, and forfeit social functions sponsored by the Company, such as the Annual Dinner and any other personal gifts by the Company to the members.  This will not be brought to the floor for a vote.  Forfeiture of gifts and social functions are for the duration of the suspension only.   

                  Section 7a  Any active member going exempt during a bingo quarter must complete that quarter as an active member. 

Section 7b Any time served for a suspension, by an active or exempt member will be held against application to go exempt or becoming a life members. 

Section 8    Any active member called to serve in the Armed Forces shall be considered to be on leave of absence and be judged a member in good standing. 

Section 9    A member serving his one year probation period before being accepted as a regular member of this Company shall be entitled to vote and shall not be entitled to propose an applicant to membership in the Company.

 

Section 10   Any member not complying with the rules set forth in the By-Laws will be subject to dismissal from the Company.  A quarterly review will be made by the Captain, Secretary, Financial Secretary and Bingo Chairman.

 

(Exempt Members)

 

Article 5.   Section 1   All exempt firemen of this Company shall have the same  rights and privileges as an active member of this Company. 

                  Section 2   Any exempt member shall be entitled to wear the regulation uniform of the Fire Department which shall become his personal property from the date of his exemption certificate. 

                  Section 3    Any exempt member in good standing in the Company for ten tears, upon his request and after inspection by the Senior Officer, shall be entitled to a new uniform to be paid by the Company.  The uniform will become the property of the member. 

                  Section 4   Any member with less than fifteen (15) years of service, but more than seven (7) years of service must attend any four (4) meeting in the calendar year and attend at least five (5) bingos per six (6) months, (based on a calendar year).  First offense will result in a sixty (60) day suspension.  A member must make ten (10) bingos per year or else the member will be dismissed from the Company.  Not complying with the rules set forth in this article, a member will forfeit his right to vote in the annual election and forfeit social functions sponsored by the Company, such as the Annual Dinner and any personal gifts made by the Company to the members.

                  Section 5  Any member not complying with the rules set forth in the By-Laws will be subject to dismissal from the Company.  A quarterly review will be made by the Captain, Secretary, Financial Secretary and Bingo Chairman.

                                                (Life Membership)

Article 6. Any member in good standing, serving fifteen (15) years in this Company shall automatically be placed on an honorable life membership list and be entitled to all privileges, be exempt from dues and be presented with a Life Membership Certificate and choice of watch or ring with $100.00 limit from the Company.

                                               (Dues) 

Article 7.  Section 1 - Any member with less than fifteen years shall pay into the Treasury of the Company ($1.00) per month for maintenance.

                 Section 2 - Any member not having dues paid in full for the July meeting will be imposed a ($6.00) penalty. (Adopted 2/1/95) 

 

                                               (Finances)

Article 8.  Section 1  All bills of the Company shall be passed on by the Company at a regular meeting and a voucher drawn for the same to be signed by the Financial Secretary and Treasurer. 

                 Section 2 All propositions exceeding ten dollars for investments, loans or donations of any property of the Company or disposal of any property including real estate shall be voted on at a regular or special meeting of the Company, at which there shall be at least 15 members present,  and no such disbursement shall be needed all members will be notified 48 hours in advance by mail.

                 Section 3  All money received by the Company shall be presented at the regular meeting and turned over to the Financial Secretary for his records.

                 Section 4  No earmarked funds of the Company may be used for any other purpose than intended and that all investments of the Company follow the same procedures as that of a change of By-Laws before being transferred from the or into the general fund.

(Withdrawal)

 

Article 9.  Section 1  No member can resign from the Company and remain in good standing unless all dues are paid, and all fire equipment is returned.

                 Section 2 All applications for withdrawal must be in writing.

 

(Reinstatement)

Article 10.  Any member, active or exempt, having been expelled for dues, may be reinstated by paying the amount of his indebtedness to the Company as shown on the books of the Financial Secretary and be voted on favorable by 2/3 majority of members present at a regular meeting of the Company, plus the regular initiation fee, if such reinstatement be for active membership.  He shall head the list unless a member who has withdrawn seeks reinstatement at the same time, who would get preference over the expelled member.
 

(Benefits) 

Article 11. Section 1 Every active member in  good standing shall be entitled  to all benefits defined by the Keansburg Firemen's Relief Association.

                 Section 2 All active members shall do the required percentages of duty governed by the New Jersey Firemen's Relief Association.

Article 12. Section 1  Should a vacancy in any office, except the line officers, occur, it shall be filled at the next regular meeting thereafter by appointment by the President until the next annual meeting.

                 Section 2  Should a vacancy occur in the line officers, the officers shall automatically move up and the existing vacancy be filled by nomination at that meeting, where said vacancy occurred, and nominations and elections to be held at the next regular or special meeting.

                 Section 3 The officers of the Company shall consist of 3 members of relief, Chief, Assistant Chief, President, Vice President, Captain, First Lieutenant, Second Lieutenant, Third Lieutenant, Recording Secretary, Financial Secretary, treasurer, 3 members of Board of Visitors, and Sergeant-at-Arms, who shall be elected at the annual meeting.  The said officers shall be nominated in November and December.

                 Section 4  No nominations for these offices can be entertained except by members present or by written consent by members not present, who must signify their consent and must be clean on the books of the Company, except if excused from the meeting in the case of emergency or legal reason.

                 Section 5  When 2 or more members run for the positions of line officer, a run-off election will be held between the 2 men receiving the most votes.  If, in the initial election, a member receives 50% or more of the vote, he will be considered the winner and a run-off will not be held.  (Definition of line officers: 3rd Lt. Through Chief)

 

(Duties of the Officers)

Article 13 Chief - The Chief shall be in command of all fires and parades.

                 Assistant Chief - The Assistant Chief shall enforce all orders given by the Chief, and in his absence act in his capacity.

                 President - The President shall preside at all meetings of the Company.  He shall sign all warrants, documents and papers requiring his signature when same be properly approved by the Company.  He shall call a special meeting of the Company when he thinks proper, or at the written consent or request of seven members of the Company.  He shall represent the Company in and before any body and place where the interest, rights, and privileges of the Company are concerned.

                 Vice President - The Vice President shall assist the President in the discharge of his official duties and shall fill his place in case of absence, death, removal or resignation.

                 Captain - It shall be the duty of the Captain to have control of the apparatus and Company equipment whenever it may be in service either at fires, drills, special duty or parades.  He shall report to the Company any member who may refuse to obey his orders while on duty.  He shall report immediately to the Commissioners any loss or damage which may occur to the apparatus or equipment.  On the death of a member he shall see that the Fire House is draped in morning for the period of thirty days.  He shall appoint the necessary drivers to serve for one year.  He shall order the Company out for drill and parades within the fire district and shall give the members at least twenty-four hours notice.  He shall also submit to the Board of Fire Commissioners a list of Fire Police and Chief and Assistant Engineer.

                 Lieutenants - The Lieutenants shall  enforce all orders given by the Captain and in his absence act in capacity according to rank.

                 Recording Secretary - It shall be the duty of the Recording Secretary to call the roll at every meeting and to keep the proceedings in a minute book of the same good order.  He shall notify all newly elected members of their election within three days thereafter, furnish them with a copy of the By-Laws of the Company, take care of all correspondence and books pertaining to this Company and be exempt from dues.  He shall also see that every member receives forty-eight hours notice elected member receives his badge and key.  Salary shall be fixed at $150.00.

                 Financial Secretary - It shall be the duty of the Financial Secretary to collect all dues and all moneys paid in, to deliver the same to the Treasurer with report and shall take his receipt for same and shall make detailed report at each regular meeting.  He shall submit his account to the Trustees whenever called upon to do so.  He shall have charge of the book pertaining to the Financial Department of the Company.  He shall be exempt from dues and shall maintain record of suspension of members for reasons stated in Article 4, section 7B.

                 Treasurer - It shall be the duty of the Treasurer to receive all monies collected by the Financial Secretary and give him a receipt for same, pay all bills approved by the Company, provided a voucher is submitted duly signed.  He shall submit a written statement of the finances of the Company monthly, and be exempt from dues.

                 Trustees - Trustees shall exercise a general supervision of all property of the Company and report at each meeting of their action takes.  Any property lost, stolen or in need of repair they will replace or order at their discretion.  They shall examine into accounts and proceedings of all officers, and have general supervision over real estate.  Any transaction exceeding five hundred ($500.00) shall be brought to the Company.  All purchases over seven hundred and fifty dollars ($750.00) to be put out on bids under direction of the Trustees and approved on the floor.

                 Sergeant-at-Arms - It shall be the duty of the Sergeant-at-Arms to guard well the door and not permit entrance to any unauthorized person or persons.  He may call upon any or all members to assist him.  He shall eject from the meeting any person so ordered from the body.  He shall see that the United States Flag is properly displayed at all meetings.

                 Fire Commissioners - It shall be the duty of the elected Fire Commissioners to represent the Company at all meetings pertaining to firematic duties and shall make a monthly report to said body.

                 Board of Visitors - A Board of Visitors consisting of three members of this Company to investigate and assist the Board of Relief in any matters pertaining to the help given to members of the Department.  They shall also supervise and operate the Fireman's death Benefit Fund in accordance with the resolution pertaining to same.  They are to be elected each regular election, terms to be staggered.

Article 14. Section 1   It shall be the duty of every active member upon alarm of fire to go to the firehouse, unless he is satisfied that the apparatus has gone and, if so, proceed at once to the fire and take his place in the Company.

                 Section 2  None but the regular constituted officers of this Company can give orders while on duty, unless in the absence of an officer.  The first ex-chief at the fire shall command until arrival of said officer.

                 Section3 No person or persons shall at any time ride the trucks other than active or exempt members of the Keansburg Fire Department, except upon order of the chief officer in charge.

(Excuses)

Article 15. Section 1  Sickness or death in the family, personal sickness, or temporary absence from town shall be deemed sufficient excuse for neglect of duty.

                  Section2  Any member being engaged in his legitimate business and so situated that he cannot attend an alarm of fire, drill, parade, or meeting shall be excused.

                 Section 3  No other excuses can be entertained, except with a two-thirds vote of all members present.

(Buildings)

Article 16. The meeting room shall be used for the use of members of the Fire Company and Ladies Auxiliary, and not to be rented, leased or loaned, except with consent of the Trustees.

(Adjournment)

Article 17.  The motion to adjourn cannot be made except by a member who has risen and been recognized by the chair.

 

                                              (BY-Laws)

Article 18.  Section1  No alterations or amendments shall be made to these By-Laws unless due notice be given to the Company in writing one month previous to the action and turned over to the By-Law committee.

                 Section2  An amendment or alteration to the By-Laws must be read at three consecutive meetings with approval of two-thirds of members present and in good standings at each meeting to become a By-Law.

                 Section 3 All meetings are to be conducted under existing Parliamentary Rules of Order as specified by H.M. Roberts Rules of Orders, revised.

                 Section 4  The foregoing laws are to remain in full force for the government of the Company from the date of their approval and, by virtue of the same, all others are hereby repealed.

(Selling of Raffle Tickets)

Article 19  Fund raising is a necessary part of being a member of the Firehouse.  Raffles will be conducted 4 times a year with exempt members being expected to sell 10 tickets per raffle.  Active members will be expected to sell 10 tickets per raffle.  Penalties for not selling raffle tickets are:

                 1st offense - 60 day suspension and time added to becoming an exempt or life member.

                 2nd offense - 6 month suspension and time added to becoming an exempt or life member.

                 3rd offense - Dismissal from the Company.

                 The member will be found to be guilty of the offense if his tickets are not paid by the meeting following the drawing and he is reported to the president by the fund raising committee (Adopted 4/4/96)
